Enforcement Policies

Enforcement Policies establish and embody the Department's enforcement strategy for violations of the Environmental Conservation Law, the implementing regulations, and Orders and Permits.

Through Enforcement Policies, consistent statewide approaches are established for evaluating such violations and assessing penalties and other sanctions. At the same time, they recognizes the importance of case-specific assessments to determine what relief is appropriate. Issuance of Enforcement Policies are intended to enhance the creditability of the Department's enforcement efforts (both administrative and judicial) by demonstrating to the regulated community and the public that DEC uses a systematic approach to evaluate and pursue violations.
