Uniform Procedures Act Regulatory Revisions

Proposed Parts 621, 421, 601

Notice is hereby given that the New York State Department of Environmental Conservation (DEC) is proposing to revise the Uniform Procedures Act (UPA) regulations that are codified at 6 NYCRR Part 621. The proposed changes to the UPA regulations are the first general update to the UPA regulations since 2006. The exact changes are summarized and fully set out in the rulemaking documents, available at the links provided below. DEC's proposal also includes corresponding minor revisions to the regulations that implement the Mined Land Reclamation Law (6 NYCRR Part 421) and the regulations governing water withdrawal permits (6 NYCRR Part 601).

Environmental and Regulatory Impact Review

DEC has determined, pursuant to the State Environmental Quality Review Act, that the proposed rulemaking will not have a significant adverse environmental impact. In accordance with the State Administrative Procedures Act, DEC has also prepared a Regulatory Impact Statement, a Regulatory Flexibility Analysis for small businesses and local governments, a Rural Area Flexibility Analysis, and a Job Impact Statement.
