Proposed Part 494, Hydrofluorocarbon Standards and Reporting

DEC is proposing a new 6 NYCRR Part 494, Hydrofluorocarbon Standards and Reporting, which adopts prohibitions on certain hydrofluorocarbon (HFC) substances in certain end-uses as previously included in the US Environmental Protection Agency, Significant New Alternatives Policy (SNAP) program. These prohibitions go into effect statewide over 2021 through 2024 and include the sale, installation, and commercial use of certain refrigerants in new or retrofitted food refrigeration equipment, large air-conditioning equipment (or chillers), and vending machines as well as prohibitions on substances used as aerosol propellants and foam-blowing agents in new consumer products. The proposal also includes administrative and record-keeping requirements for manufacturers of the affected products.

Three public hearings for the proposed rule will be held as follows at locations that are reasonably accessible to persons with impaired mobility:

The Department will give equal weight to written and oral statements, and since a cumulative record will be compiled it is not necessary for interested parties to attend each hearing. The Department will provide interpreter services for hearing impaired persons at no charge upon written request submitted no later than February 19, 2020.
