Adopted Part 257 Air Quality Standards and Classifications

Part 257, Subparts 257-2 through 257-10, list the NYS Air Quality Standards (SAQS) promulgated by DEC over several decades. A number of these SAQS are outdated and have been superseded by Federal air quality standards, and DEC has either revised or repealed them.

The following subparts, which have been superseded by stricter Federal regulations, are repealed:

257-3 - Air Quality Standards - Particulates

257-3.3 Standards for Suspended Particulates. The 24-hour suspended particulate (PM10 particles) standard is outdated. The Federal annual PM10 standard was repealed in 2006 but NYS still listed an annual standard in Subpart 257-3.

257-4 - Air Quality Standards - Carbon Monoxide

257-5 - Air Quality Standards - Photochemical Oxidants

257-6 - Air Quality Standards - Hydrocarbons (non-methane)

257-7 - Air Quality Standards - Nitrogen Dioxide (NO2)

257-9 - Air Quality Standards - Beryllium

The State Ambient Air Quality Standards for Fluorides and Hydrogen Sulfide, 212- 8 and 212-10 respectively, are revised to allow for improved monitoring methods.

  • Adopted Part 257 Rural Area Flexibility Analysis - Defined as counties with populations of fewer than 200,000 people and towns in non-rural counties where population density is less than 150 people per square mile, this must state any impacts or requirements imposed upon rural areas. This must also express opportunities provided for rural citizens, businesses or organizations to participate in the rulemaking.
  • Adopted Part 257 Regulatory Flexibility Analysis for Small Business and Local Governments - Consideration of, and steps taken by the Department, to minimize any negative impacts on small businesses (independently owned businesses wholly within New York State of 100 employees or fewer) or local governments. This includes an explanation of what opportunities were provided to these entities to participate in the rulemaking process.
  • Adopted Part 257 Assessment of Public Comments - Comments received from July 17, 2019 through 5 pm September 23, 2019
