Emergency Adoption Part 218, Emission Standards for Motor Vehicles and Motor Vehicle Engines

The Department of Environmental Conservation has adopted an emergency regulation amending 6 NYCRR Part 218 and 6 NYCRR Section 200.9 to incorporate California's latest greenhouse gas (GHG) standards, which were adopted by California on December 12, 2018, into New York's existing low emission vehicle (LEV) program. This revision to 6 NYCRR Parts 200.9 and 218 were effective upon filing with the New York Department of State, December 21, 2018. The amendment clarifies the deemed to comply provision for model years 2021-2025, which allows vehicle manufacturers to demonstrate compliance with federal GHG standards in lieu of California's more stringent standards. The deemed to comply provision was revised in response to the U.S. Environmental Protection Agency's stated intent to freeze and roll back existing GHG standards for model years 2021-2025. Further, the Department proposes to submit the Part 218 as well as the revisions to Part 200 to EPA as a revision to the State Implementation Plan (SIP) for New York State.
