Pursuant to New York State Department of Environmental Conservation (DEC) Organization and Delegation Memorandum 94-13, I have reviewed the proposed permit in this matter. This permit: (1) is accepted by DEC Staff and the permittee; (2) resolves all outstanding issues; and accordingly, (3) the permittee withdraws its request for a hearing.
Based on the above, this matter is remanded to DEC Staff to take all steps necessary to issue the final permit.
