PROCEEDINGS

Background

The New York State Department of Environmental Conservation (DEC or Department) is proposing to amend Part 205 of Title 6 of the New York Compilation of Codes, Rules and Regulations (6 NYCRR), Architectural and Industrial Maintenance (AIM) Coatings, and associated revisions to New York's State Implementation Plan (SIP).

Hearing Notice

Notice of these hearings was published in the December 6, 2006 editions of the Environmental Notice Bulletin, the State Register, Albany Times Union, Syracuse Post-Standard, Glens Falls Post Star, Rochester Democrat and Chronicle, The Buffalo News, New York Post, and Newsday. Written comments will be received by Department staff until January 22, 2007.

DEC Administrative Law Judge (ALJ) P. Nicholas Garlick presided over the Avon and Albany hearings and ALJ Kevin J. Casutto presided over the hearing in Long Island City.

No members of the public offered testimony at either the New York City or Avon hearings. One person, Madeline Harding, representing Sherman Williams spoke in favor of the proposed changes to the regulations and SIP revisions at the Albany hearing.

At each hearing, DEC Staff member read a statement summarizing the proposed revisions and the rationale therefor. At the New York City hearing, DEC Staff member Diana Menasha spoke. At the Avon hearing, DEC staff member Michele Kharroubi spoke. At the Albany hearing, DEC Staff member Daniel Brinsko spoke.
