RULING ON REQUEST FOR
FURTHER EXTENSION OF STAY
DMN Project No. DMN-02-03

September 19, 2003

The Department of Environmental Conservation ("DEC" or "Department") Staff has proposed issuance of an Order which would establish field-wide spacing and integration rules for the Terry Hill South natural gas field (the "Field"). The Field is situated on portions of acreage located in the Towns of Catlin and Veteran, in Chemung County, and the Towns of Dix and Montour, in Schuyler County. A June 5, 2003 ruling granted Department Staff's motion to stay the issues ruling pending a determination on a declaratory ruling which is before the Department's General Counsel. The June 5 Ruling, which is incorporated here by reference, set a date of August 8, 2003 for the receipt of any request for a further extension. By letter dated August 7, 2003, Department Staff requested an extension. The Applicant and several of the proposed intervenors objected to the request.

Department Staff's request for a further extension is granted, and consideration of the issues ruling will be suspended until November 3, 2003, unless the declaratory ruling is issued in the interim. Any application for a further extension must be received in this office on or before October 30, 2003.
