AMENDED
ORDER
JOHN RING, individually and in his
capacity as an officer of
A-Z Exterminating, Inc.
and
A-Z Exterminating, INC., a/k/a A-Z Exterminating Co.,
Respondents.
WHEREAS:
- By Commissioner's Order dated August 26, 1994, the Respondents were found in violation of the Environmental Conservation Law and regulations regarding pesticides.
- Penalties of $20,000 were assessed against the Respondents jointly and severally, in addition to other relief awarded against them.
- Upon reading and filing the Motion of Louise Aja, dated September 8, 1994, seeking an Amended Order establishing a payment date for the penalties awarded against Respondents, and there having been no opposition to the Motion from Respondents, I find that Staff is entitled to an Amended Order establishing a payment date for the previously assessed penalties. In all other respects, the Commissioner's Order of August 26, 1994, is unchanged.
NOW, THEREFORE, having considered this matter, it is ORDERED that:
- Respondents herein are jointly and severally liable to the State for payment of the sum of Twenty Thousand Dollars ($20,000.00) within thirty days of the date of service of this Amended Order upon them.
- All communications between Respondents and the Department concerning this Amended Order shall be made to the Director, New York State Department of Environmental Conservation, Region 1 Headquarters, Building 40, S.U.N.Y. Stony Brook, New York, 11790.
- The provisions, terms and conditions of this Amended Order shall bind the Respondents, their agents, servants, employees, successors and assigns, and all persons, firms and corporations acting for or on behalf of Respondents.
