SUPPLEMENTAL ORDER

WHEREAS:

1. The Decision and Order dated March 9, 1994 found the Respondents in violation of 6 NYCRR 360-13.1(b) and assessed a civil penalty without specifying the date upon which the unsuspended portion of that penalty must be remitted.
2. The Department Staff have requested that the aforementioned Order be supplemented to establish the date upon which the civil penalty is due and payable.

NOW THEREFORE, having considered this matter, it is ORDERED that:

1. The unsuspended portion of the civil penalty assessed jointly and severally against Respondents in the March 9, 1994 Order in the amount of $20,000 (TWENTY THOUSAND DOLLARS) shall be due and payable on June 30, 1994.
2. All communications between the Respondents and the Department Staff concerning this Order must be made to the Department's Region 8 Director, 6274 East Avon-Lima Road, Avon, New York 14414.
3. The provisions, terms and conditions of this Order will bind the Respondents, their agents, servants, employees, successors and assigns, and all persons, firms and corporations acting for or on behalf of the Respondents.
