This Ruling addresses the motion made by the Catskill Preservation Coalition (CPC), dated December 23, 2004, and returnable on January 11, 2005, for an order to reopen the issues conference record in the above captioned matter to allow the receipt of two documents annexed to its motion as Exhibits A and B. Exhibit A is a 62 page document, including maps and appendices, entitled "The Future of Belleayre Mountain." While this document is dated November, 1995, it includes and is prefaced by a three page open letter from the Route 28 Corridor Committee dated January 3, 1997. Exhibit B is a copy of the text of the SEQRA Negative Declaration made by the Department of Environmental Conservation, as lead agency, and published in the Environmental Notice Bulletin on December 15, 2004, with respect to certain proposed management objectives expressed in the draft 2004 Unit Management Plan Amendment for Belleayre Mountain/Intensive Use Area.
In response to the motion, by letter dated January 3, 2005, the Applicant, Crossroads Ventures, LLC, indicated that it had no opposition to the introduction of the above documents into the issues conference record. No other responses to the motion were filed with the Office of Hearings.
The motion by CPC is granted and the document entitled "The Future of Belleayre Mountain" and the text of the SEQRA Negative Declaration of December 15, 2004, both annexed to its motion of December 23, 2004, as Exhibits A and B, respectively, will be received into the record of the issues conference in this matter.
