Project Description: The applicant has applied to the New York State Department of Environmental Conservation for Protection of Waters permits (Dam Safety and Stream Disturbance) and for Water Quality Certification under Section 401 of the Clean Water Act to construct a proposed 497-unit residential development known as Patrick Farm, located south of the intersection of NYS Routes 202 and 306 in the Town of Ramapo.

Two Class B protected tributaries to the Mahwah River, Brian Brook and an unnamed stream, cross the 208-acre site. Proposed disturbances to these two streams include reconstruction of an existing failed earthen dam which impounds a five (5) acre pond (located at the headwaters of the unnamed tributary) with a new concrete retaining wall, replacement of an existing undersized culvert with a 10 foot wide box culvert, construction of rip-rap outlet protection for a stormwater basin discharge to the bank of the unnamed tributary to the Mahwah River, and construction of two new three-sided culverts as roadway crossings to serve the development (one crossing of each on-site stream).

Legislative Public Hearing: Pursuant to 6 NYCRR 621.8 the NYSDEC has scheduled a legislative public hearing to be conducted in two (2) sessions on January 7, 2013 at the Joseph T. St. Lawrence Community, Health and Sports Center, 115 Torne Valley Road, Hillburn, NY 10931, contact phone number: 845-753-2324. The first session will begin at 3:00 pm and the second session will begin at 6:30 pm. The legislative hearing is to receive unsworn comments on the proposed project. Written comments may also be submitted.

All persons, organizations, corporations, or government agencies who may be affected by the proposed permits are invited to attend the hearing and to submit oral or written comments on the application. It is not necessary to file in advance to speak at the hearing. Lengthy comments should be submitted in writing. Equal weight will be given to both oral and written statements. The administrative law judge (ALJ) may limit the time available for oral comments to 5 minutes per person to ensure that all persons have an opportunity to be heard. The hearing facility is reasonably accessible to the mobility impaired.

Translator services shall be made available, at no charge, upon written request to the ALJ. All requests must be made to the NYSDEC Office of Hearings and Mediation Services, ALJ Molly T. McBride, 625 Broadway, First Floor, Albany, New York, 12233-1550. (518) 402-9003. The request must be received no later than 4:00 p.m. on January 2, 2013. Interpreter services shall be made available to deaf persons, at no charge, upon written request to the ALJ at the address listed above by January 2, 2013.

SEQR Status:

Pursuant to Part 617 of the New York State regulations for Article 8 [State Environmental Quality Review (SEQR) Act], the Town of Ramapo Town Board is lead agency and has issued a positive declaration for this Type I action. A draft Environmental Impact Statement has been prepared and is on file.
