Project Description:

The Mark Twain State Park's Soaring Eagles Golf Course has applied for a new non-public water withdrawal permit for an existing withdrawal for irrigation water from a kettle pond fed by Catherine Marsh/Creek. The golf course has operated since 1968, and replaced the aging irrigation system in 2021-2022 with a more efficient system that decreases overall water use. The Department proposes to authorize the continued withdrawal of up to 600,000 gallons per day (GPD) of water for non-public use.

The present pond-fed water withdrawal is used only for irrigation at the golf course. Drinking water is supplied to to the facility from two groundwater wells that are below NYSDEC withdrawal permitting thresholds and regulated by the NYSDOH.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Office of Parks Recreation & Historic Preservation

State Historic Preservation Act (SHPA) Determination:

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve the modification of the City of Hornell's Water Pollution Control Plant's existing SPDES permit by making the following changes:

  • The Total Phosphorus limit compliance schedule due date has been extended from April 30, 2023 to May 1, 2024;
  • The flow measurement monitoring point has been relocated from the effluent Parshall flume to the treatment plant influent; and
  • A typo for the WET Testing action level has been corrected from 0.91 TUa to 0.3 TUa

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. Refer to this application by the application number listed above and SPDES Number NY0023647.
