Negative Declaration

Erie County - The Town of Hamburg Town Board , as lead agency, has determined that the proposed Amendments to Chapter 280 "Zoning" of the Town Code will not have a significant adverse environmental impact. The action involves amending Section 280-133A of the Code to remove bituminous processing facilities as a permitted use in the M-3 zoning district of the Town and amendment to Chapter 280, adding Article LVII entitled "Bituminous Processing Facility" prohibiting asphalt plants and bituminous processing facilities in the Town of Hamburg. The project is located throughout the Town of Hamburg, New York.

Erie County - The City of Buffalo Planning Board, as lead agency, has determined that the proposed McCarley Gardens Redevelopment Phase 2 will not have a significant adverse environmental impact. The action involves the construction of a 6story mixed-use building (265,680 square feet), consisting of retail space (21,000 square feet) on the first floor and 220 apartments on the second through sixth floors, on a new 1.63 acre parcel, to be created from an existing 14.99 acre parcel, at 172 Goodell Street. As part of the proposal to subdivide the 14.99 acre parcel, North Oak Street would be re-routed from its current intersection with Ellicott Street straight to the north to intersect with Virginia Street. A total of 161 parking spaces are proposed on the ground level and below surface on site, with vehicle access provided from the proposed reconfigured North Oak Street. The action has been defined broadly to include all proposed site improvements as well as all required discretionary approvals and permits needed for the project. The project is located at 172 Goodell Street in the City of Buffalo, New York.
