Project Description:

The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve a renewal and modification to the State Pollutant Discharge Elimination System (SPDES) permit NY0020966, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

This facility is a publicly owned treatment works that receives flow from domestic users, with effluent consisting of treated sanitary wastewater. The facility does not have any significant industrial users. The treatment plant has a current design flow of 0.78 MGD. Current treatment consists of preliminary, secondary, tertiary, and disinfection. The primary outfall (Outfall 001) is bank discharge from a pipe embedded in a concrete headwall to Dodge Creek, a Class C water, 400-feet upstream of its confluence with the Allegheny River, a Class C water.

The following changes to the permit are proposed: updated permit format, definitions, and general conditions; added monitoring for dissolved oxygen as daily minimum year-round; added monitoring for Total Dissolved Solids daily maximum year-round; added monitoring for Total Phosphorus; added Ammonia (NH3-N) limits as monthly average for Summer and Winter seasons; and added Mercury limits as 12 months rolling average (12MRA) with semiannually sampling frequency. The facility is planning the following upgrades/improvements: empty community settling tank; restore influent pump station; restore filter beds; restore UV disinfection equipment; empty sludge silo, and repair/restore collection system.

As a result of the EBPS full technical review, a new five-year term is proposed. The permit includes updated forms and the latest general conditions. The draft permit files are contained within regional folders and named by the SPDES number contained in this notice. Requests for a legislative (public statement) hearing must be sent in writing to the NYS DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has received an application for the stabilization of approximately 100 linear feet of shoreline with armor stone and rip rap. The project will involve cutting a toe channel and placing armor stone into the toe with the rip rap being placed behind the armor stone. The project is located at 4482 Lower River Road in the Town of Lewiston. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance.

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
