Project Description:

The Department has prepared a draft permit and has made a tentative determination, subject to public comment or other information, to approve modifications to the SPDES permit for the Chemung Co. Sewer District #1 STP, (the Lake Street Plant) which is permitted to discharge 12 million gallons per day (MGD) to the Chemung River.

The draft permit authorizes a temporary change to the outfall location to send effluent to a former outfall 003 which is a 14,700-LF, 48-inch diameter conveyance to the bank of Newtown Creek, during the rehabilitation of the existing conveyance structure (to the Chemung River), which will allow the County to eliminate the need for a significant bypass pumping operation, while the conveyance structure is rehabilitated. This is part of the Chemung Consolidation Sewer Project (CCSD) which includes consolidation of this Chemung County Sewer District #1 (Lake Street) and the Milton Street Plant, into a single new regional plant, at the Milton Street location. The permit includes a new effluent table for discharge to Newtown Creek (outfall 003) and interim limits for both outfalls, to be applied during construction, in the compliance schedule. The draft permit also authorizes an additional 13 months for construction of the regional consolidated facility, in the Schedule of Compliance, and other minor corrections, including updating permittee contact information, reformatting tables, and adjusting monitoring types.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. A Part 182 Permit application for Endangered and Threatened Species, taking of mussels for the Chemung River crossing, will be public noticed separately, see 8-0799-00026/00002. A Protection of Waters Permit, for sediment removal, at the new outfall 003 in Newtown Creek, will also be required.

Project Description:

The Department has prepared a draft Air State Facility permit and made a tentative determination to approve, subject to public comment or other information, this application by Louisiana Pacific Corporation (LP), that proposes to construct and operate a siding preparation and pre-finishing facility (LP New York Project) in the Town of Bath, New York.

Proposed facility operations include a pre-finishing operations for siding products that include automatic coating lines, a shake/panel line, spray booths, a curing oven and space heaters. The associated processes are:

  • LN1 covered under Emission Unit [U-00001],
  • LN2 covered under Emission Unit [U-00002],
  • MB1 covered under Emission Unit [U-00003],
  • MB2 covered under Emission Unit [U-00004],
  • MB3 covered under Emission Unit [U-00005].

The coating line processes for all emission units are subject to 6 NYCRR Subpart 228-1 for Surface Coating Operations and 6 NYCRR Part 212 for contaminants containing cobalt and manganese as they were deemed to be A-rated. As part of compliance with applicable 6 NYCRR Part 212 requirements, the facility must install and operate a paint booth filter with at least 99% for manganese and cobalt compounds from coating operations. The facility is also subject to 6 NYCRR Subpart 228-1 coating VOC limit requirements, coating storage and handling requirements, and opacity requirements.

A federally enforceable emissions cap for VOC is established to limit facility emissions below Major Source Thresholds. Associated monitoring conditions are included to ensure compliance with the cap.

Pursuant to the requirements of Section 7(2) of the Climate Leadership and Community Protection Act (CLCPA), the Department has requested and received information regarding the project's consistency with the CLPCA.

Project Description:

The applicant, Greenidge Generation LLC, proposes to install cylindrical wedge wire intake screens (CWWS) at the Facility's existing cooling water intake structure. The installation of the CWSS is a requirement of the Facility's SPDES permit. The facility's SPDES permit was modified in 2017 to include the CWWS as part of the Department's review of the facility's cooling water intake pursuant to Section 361b of the Clean Water Act and 6 NYCRR Part 704.5. The 0.5 mm slot width CWSS was determined to be the "Best Technology Available" (BTA) to minimize entrainment and impingement of aquatic resources. The existing cooling water intake that extends above water approximately 730 feet from the shoreline into Seneca Lake. The modified structure will consist of an intake box and six intake screens. The installation will include the removal of the steel walls of the existing intake structure to be replaced with precast concrete. The excavation area required for the replacement of the intake walls and installation of the CWIS will be approximately 82' X 95' and requires the hydraulic dredging of approximately 1,100 cubic yards of material. Approximately 200 cubic yards of coarse limestone will be placed around the intake box to stabilize the dredged area. The dredged material will be dewatered in an upland area utilizing a filter bag within an enclosed bermed area of approximately 15,000 square feet. In addition, wooden pilings supporting the wooden trestle that holds the 7-foot diameter cooling water intake pipe will be replaced with steel pilings. The facility is located on the western shore of Seneca Lake.
