Project Description:

The applicant is proposing temporary disturbances to Oquaga Creek [NYS Water Index #: D-71-10, Class C(T)] in association to a stream stabilization project to reduce stream bank erosion and improve natural habitat. The proposal includes the following: installation of 850-linear-feet of toewood and 200-linear-feet of rootwad revetment in stream sections that are experiencing high erosion; four stream channel grade features (converging rock clusters and J-hooks) at the upstream and downstream limits of the project site; and re-establishment of a riparian buffer with the incorporation of native riparian trees, shrubs and forbs. Stream stabilization features that will be utilized are highly recommended by DEC and the project anticipates approximately 1100-linear-feet of stream disturbance. Proper erosion and sedimentation controls will be implemented to protect downstream water quality, including a pump around system to pass clean water through the project site. The project, once complete, will result in the reductions of erosion and sedimentation within the stream system, improvement of stream flow dynamics, and an increase in fish and wildlife habitat through the stream corridor.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The NYS DEC prepared a draft permit and made a tentative determination, subject to public comment or other information, to approve a modification to the City of Oneida Sewage Treatment Plant's State Pollutant Discharge Elimination System (SPDES) permit. The facility, located at 387 Harden St., City of Oneida, is permitted to discharge 4.5 MGD of treated wastewater to the Oneida Creek, and seasonally a portion of the treated wastewater is conveyed to the Turning Stone Casino for golf course irrigation. The permittee requested modification includes Chlorinated Phenol limits, discharged to Oneida Creek, will be changed from 5.0 ug/L to monitor only while a work plan is developed to demonstrate compliance with final discharge limits (5.0 ug/L); Chloroform limits, discharged at the golf course, will be changed from 7 ug/l to monitor only while an engineering report is developed which will detail how the facility will comply with the discharge limits (7 ug/L). Additionally, the sampling frequency for fecal coliform and residual chlorine will be updated.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline.
