Project Description:

The New York State Department of Environmental Conservation (department) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY0005959, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA).

Bethlehem Energy Center (BEC) is a 750 MW combined cycle electric generating facility. Treatment consists of clarifier, filter and demineralization (Reverse Osmosis) units. Treated discharge is via Outfalls 001, 002, 003A, and 003C to the Hudson River, a class C water.

The following changes to the permit are proposed: 1) updated: a) cover page, b) permit limits, levels and monitoring definition section, c) discharge notification requirements, d) monitoring locations, and e) recording, reporting and additional monitoring requirements; 2) changed: a) outfall 001 and 003A added monthly average concentration limit, monthly average and daily maximum loading limits for total suspended solids, and modified the total residual chlorine daily maximum limit, and b) named outfall 03A to 003A and 03C to 003C; 3) deleted: a) outfalls 04A and 004, b) short term high intensity monitoring, c) special conditions/additional permit requirements No.'s 6-9 and 12, and the list of authorized water treatment chemicals (now included as general conditions), and d) notice of intent for onsite chemical cleaning; 4) added: a) general permit requirements, b) special conditions/additional permit requirements No 6 for metal cleaning, and c) schedule of submittals.

As a result of the EBPS full technical review, a new five-year term is proposed. The permit includes updated forms and the latest general conditions. Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

Project Description:

The Department has prepared a draft permit and made a tentative determination, subject to public comment or other information, to approve the application submitted by the New Athens Generating Company LLC to renew the Title V Permit for the Athens Generating Plant with minor changes. The draft permit renewal would allow for the continued operation of existing infrastructure and does not include any new, expanded, or modified operations. The operations covered by the draft permit include the operation of three combined-cycle Westinghouse 501G combustion turbines to fire natural gas or distillate oil (alternate), heat recovery steam generators, and steam turbine generators (115 MW) to generate a maximum of 1,080 megawatts of electricity. The facility controls the emissions of nitrogen oxides using dry low-NOx (DLN) combustion and water injection in the combustion turbines and selective catalytic reduction (SCR) in the heat-recovery steam generators.

Minor changes to the permit will include administrative updates, a new Minimum Emissions Compliance Load (MECL) requirement to increase operational flexibility, and removing three (3) 20,000-gallon aqueous ammonia storage tanks as an emission unit since they are now exempt.

In accordance with 6NYCRR Parts 621.7(d)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The project involves the following within an unnamed Class C Stream (FIN# H-240-89-2):

  • Slip lining of an existing 8' x 8' concrete box culvert with a 7' diameter HDPE pipe;
  • 100' of stream re-alignment upstream of the existing culvert inlet; and
  • 240 feet total of linear stream disturbance, and 85.9 cubic yards of fill below the mean high water mark.
