Project Description:

The Department has received an application for the renewal of the Zoladz C&D Facility's Solid Waste Management Permit. The facility accepts up to 1,000 tons per day of C&D wood debris, railroad ties, and other creosote treated lumber. The material is processed into alternative fuel to produce electricity at another site. This renewal application includes a modification of the permit to incorporate existing mulch processing operations, as required by 6 NYCRR Part 360-4. The facility currently has a Solid Waste Management Facility Registration for this operation, which includes the acceptance of up to 1,500 cubic yards per day of yard debris, tree debris, and unadulterated wood debris for processing into a mulch product. The Department is seeking public comment prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has made a tentative determination, subject to public comment or other information, to approve the application of Sunoco Tonawanda Terminal's renewal of its Title V Permit. This draft permit renewal would allow for the continued operation of existing infrastructure and does not include any new, expanded or modified operations. Sunoco Tonawanda Terminal is a bulk marketing terminal for distributing gasoline, diesel fuel and ethanol. The facility is subject to 6 NYCRR Part 201-6, Title V Permits, for major stationary sources due to potential emissions of volatile organic compounds (VOC) in excess of 50 tons per year (tpy). The facility is also subject to 40 CFR Part 63 BBBBBB. Sunoco will continue to restrict the emissions of hazardous air pollutants (HAP) below the 40CFR Part 63 Subpart R applicability threshold of 10 tpy of any individual HAP and 25 tpy of all HAP compounds combined by limiting throughputs in any consecutive 12 month period to 240,000,000 gallons of gasoline and 96,000,000 gallons of distillates.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
