The Department has made a tentative decision to re-issue and modify a previously expired SPDES permit for the Phelps 7-Eleven Store at the corner of State Route 14 and Route 318 to authorize an existing discharge of stormwater from diesel pad retention pond to groundwater and overflows from the retention pond to a tributary of Canandaigua Outlet. The sanitary discharge of less than 1,000 gallons per day is exempt and was removed from the permit. The draft permit contains a compliance schedule for needed changes, the addition of ethyl benzene limit, removal of temperature and modification of Xylene isomers limit.

Project Description:

The New York State Department of Environmental Conservation (DEC) is hereby renoticing a proposed renewal and Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY0029289, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS) to the Village of Interlaken Sewage Treatment Plant. The facility is permitted to discharge a monthly average of 0.10 million gallons per day of treated sanitary wastewater via outfall 001 to Minors Creek, a class D water. Treatment consists of a bar screen, clarigester, trickling filter, secondary clarifier and chlorine contact chamber. The applicant proposes to upgrade the plant to a membrane bioreactor (MBR) to meet intermittent stream effluent limits with phosphorous (P) removal and UV disinfection. The Department has made a tentative determination to issue a modification to the permit to include: an updated mercury minimization program; additional flow monitoring and new limits for dissolved oxygen, ammonia and P; decrease in limits for TSS, settleable solids, BOD5 and TRC; and updated compliance schedule for plant upgrades, final effluent limit attainment, and reduction in infiltration and inflow.
