Project Description:

The Department has made a tentative determination, subject to public comment or other information, to approve the application of the Chemung County Landfill Title V fourth renewal. This draft renewal permit would allow for the continued operation of existing infrastructure at the municipal solid waste landfill and the operation of the construction and demolition debris (C&D) landfill. It does not include any new, expanded, or modified operations. The operations covered by the draft permit include acceptance of municipal and non-hazardous mixed waste; certain oil and gas exploration wastes; commercial and industrial wastes; and other wastes included in the current Part 360 permit at a rate of 417,000 tons per year. The permit also covers emissions from the onsite C&D landfill which is permitted at a rate of 20,500 tons per year.

The renewal will authorize the continued operation of the gas collection and control system to reduce emissions and limit odors at the facility. The Draft Title V Permit includes air pollutant emission limitations, compliance schedules, and periodic monitoring requirements to ensure and verify compliance with the applicable requirements.

Existing permitted emission points at the Landfill currently include 8 candlestick flares, a 793 scfm open flare, a 1,200 scfm open flare (authorized under Operational Flexibility provisions), and fugitive emissions from the Landfill and the leachate collection pond. Although the landfill is not yet subject to the gas collection and control requirements of 40 CFR 60 Subpart XXX, the landfill has installed an active gas collection system for the purposes of odor control and as required by the Department to control fugitive emissions under 6NYCRR Part 212. The facility, however, remains subject to Title V permitting requirements due to the applicability of 40 CFR 60 Subpart XXX and remains a minor source pursuant to Non-Attainment New Source Review with the exception of greenhouse gases (GHGs) for which the facility is a major source.

The Potential to Emit includes fugitive emissions from approximately 8,154,588 cubic yards of additional air space from the Cell V expansion; the existing candlestick flares (FL001-FL008); the existing 793 scfm open flare (01FLG); the permitted 1,200 scfm open flare (FLR01); a new 2,040 scfm enclosed flare (FLR02); and other miscellaneous and exempt sources.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant is proposing to dredge approximately 1,200 cubic yards of accumulated material to improve navigation in a 0.2-acre channel area located near the mouth of Johnson Creek as part of NY State's REDI Dredging program. Dredged material will be taken (via dump scow or piped) to an approximately 1.4 acre area within the Lake Ontario littoral drift system located approximately 700 feet offshore of the Lake Ontario shoreline immediately east of Johnson Creek.
