Negative Declaration

Ontario County - The Town of Phelps Planning Board, as lead agency, has determined that the proposed NY CDG Ontario 4 LLC Solar Project will not have a significant adverse environmental impact. The action involves the development of plans by NY CDG Ontario 4 for the installation of a 5 megawatt (MW) alternating current (ac) photovoltaic array on 16 ± acres of a parcel totaling 59 ± acres. The array will include approximately 140 free standing tracking solar table modules, consisting of about 11,500 panels. These structures will stand approximately 12 foot in height. The system will also include new electrical equipment, accessories, concrete pads for equipment, fencing, and a new gravel access drive. The maximum depth of excavation will not exceed 4 foot, but the helix screws (or H-piles) of the solar tables will be installed at a depth of approximately 8 to 10 foot. Approximately 0.7 acres of trees will be removed as well as approximately 1.25 aces of shrub/scrub. Only about 0.1 acres of new impervious surface will be created as a result of this project. Ontario County - The Town of Canandaigua Planning, as lead agency, has determined that the proposed County Road 10 Aura Solar Project will not have a significant adverse environmental impact. The action involves a 15 ± acre solar farm (3.25 ± MW) on a 17.98 acre parcel. Approximately 15.42 acres of the 17.98 acre parcel will consist of solar panel coverage. The project will involve the installation of ground mounted photovoltaic panels as well as an access road, electric utility upgrades, power inverters, and perimeter fencing for the solar farm. The project is located at 2890 County Road 10 in the Town of Canandaigua, New York.

Orleans County - The Town of Carlton Planning Board, as lead agency, has determined that the proposed Waterport Carlton Rd, LLC - Solar Project will not have a significant adverse environmental impact. The action involves the construction of an approximately 4.4 MW-AC solar array on approximately 26.7 acres of an existing estimated 102 acre parcel. Activities include the installation of a ground mounted solar energy system of approximately 12,700 freestanding tracking modules/panels, new electrical equipment including 4 transformers on concrete pads, and accessories including approximately 2,417 linear foot of underground electrical wiring, unimproved and pervious gravel access roads (accessed from Park Avenue) and chain link fence. The maximum depth of ground disturbance will not exceed 4 foot and the H-piles of the solar tables will be installed at a depth of 6 to12 foot. Each row of solar tables will be about 11.5 foot in height (20 foot. maximum, 7.8 foot in width maximum), and of variable length, with low-growth pollinator-friendly seed mix planted underneath. Landscaping is proposed on the west and south side of the project area, as the north and east side of the site has an existing tree and brush line which provides a natural screening. There will be minimal vegetation removal and minimal grading from solar module. The project is located at 13759 Waterport Carlton Road in the Town of Carlton, New York.

Steuben County - The Town of Prattsburgh Town Board, as lead agency, has determined that the proposed Wind Energy Facilities Local Law of 2021 will not have a significant adverse environmental impact. The action involves the adoption of a Local Law for the purpose of regulating wind energy facilities that are constructed and operated in the Town of Prattsburgh. The project is located throughout the Town of Prattsburgh, New York.

Wayne County - The Town of Macedon Town Board, as lead agency, has determined that the proposed Oakridge Glen Total Plan Development Zoning Development Plan will not have a significant adverse environmental impact. The action involves the a proposal by the applicant for the rezoning 85 acres from GC (General Commercial) and R-30 (Residential) to a Totally Planned
Development. The project has a maximum build out density of 280 residential dwelling units constructed in a mix of 3 and 5 unit building pods. There are 3 commercial development pads total. The project would be developed in multiple phases over several years, and include Town dedicated water and sewer infrastructure, and a mix of Town dedicated, and private access roads. The project is located at 240-R NYS Route 31, on the south side, across from the intersection of Macedon Parkway, in the Town of Macedon, New York.
