Shandaken SPDES Semi-Annual Meeting

The New York City Department of Environmental Protection (NYC DEP) is pleased to announce that the next semi-annual public meeting, held per the Shandaken SPDES permit, will be on Thursday, August 26th at 10:00 a.m. NYC DEP will discuss the progress of activities conducted pursuant to the SPDES permit. On June 30, 2021 New York State Department of Environmental Conservation (NYS DEC) issued a Notice of Complete Application (NOCA) in the Environmental Notice Bulletin (ENB) commencing the public review and comment period for the referenced draft permits and associated applications. This Notice serves to provide the public notification that the DEC will hold public comment hearings on August 23 and 25, 2021 as described below.

Project Description

Danskammer Energy, LLC (Danskammer or Facility) is proposing to construct a new natural gas fired combined cycle power generation facility, the Danskammer Energy Center, in the Town of Newburgh, Orange County, New York, which will consist of an optimal 536 net megawatt (MW) facility located at the site of its existing Danskammer Generating Station. The proposed Facility (combustion turbine) will be primarily fueled by natural gas with ultra-low sulfur diesel (ULSD) as a backup fuel for up to the full load equivalent of 720 hours per year.

Please take notice, that consistent with the federal Centers for Disease Control (CDC) guidelines, fully vaccinated individuals do not need to wear masks or socially distance during the hearing sessions. Unvaccinated/unknown vaccination status individuals need to maintain six feet of social distance and need to wear masks, in accordance with the federal CDC guidelines.

In addition to the in-person hearing sessions, virtual public comment hearing sessions will be conducted electronically before ALJ Caruso through the Webex Events electronic webinar platform. The virtual sessions will begin at 1:00 P.M. and 6:00 P.M. on August 23, 2021. Legislative Public Comment Hearings and Written Comments

All persons, organizations, corporations, or government agencies which may be affected by the proposed project are invited to attend the public comment hearings and to submit oral or written comments. It is not necessary to speak at both the virtual and in-person hearings, as equal weight is given to statements made in each forum.

Persons who wish to speak at an in-person hearing session are encouraged to pre-register by 10:00 a.m. on August 24, 2021. To pre-register, contact the NYS DEC - Office of Hearings and Mediation Service by telephone at (518) 402-9003, or by email at Please provide your first and last name, address, and telephone number, reference the Danskammer public comment hearing, and indicate the session you wish to speak at. Instructions for registering to speak at a virtual hearing session may be accessed as indicated above.

Lengthy statements should be in writing and summarized for oral presentation. Reasonable time limits may be set for each speaker to afford everyone an opportunity to be heard. Equal weight will be given to both oral and written statements. The hearing locations are fully accessible to persons with mobility impairment. Interpreter services shall be made available to deaf persons, and translator services shall be made available to persons with limited English proficiency, at no charge for either service, upon written request to the ALJ at least 10 days prior to the hearing. Written comments submitted to NYS DEC during this comment period and oral comments given at any of the legislative public comment hearings are considered part of the record. At the conclusion of the public comment period, NYS DEC staff will determine pursuant to 6 NYCRR 621.8 whether substantive or significant issues have been raised in the public comments or legislative hearing to warrant an adjudicatory hearing, or whether a final decision should be made on the applications without any further adjudication. If no issues are raised to warrant further adjudication, the NYS DEC will proceed to final decision. In case of a determination to issue the requested permits, the NYS DEC will develop a response to comments, provide public notice of the approval of the permits and issue the requested permits.

Negative Declaration

Orange County - The Town of Wallkill Planning Board , as lead agency, has determined that the proposed Golden Triangle will not have a significant adverse environmental impact. The action involves the construction of 850,069 square foot warehouse and light industrial development in four buildings with associated site improvements, which include parking, loading docks and stormwater management facilities, access roads from Silver Lake Scotchtown Road. Additional off-site traffic improvements are also proposed. Each building will be connected to public water and sewer services provided by the Town of Wallkill.

The project consists of 92.7 acres located northwest of the intersection of NYS Route 17/I-86 and NYS Route 211 and south of Silver Lake Scotchtown Road in the Town's ENT-L Zoning District in the Town of Wallkill, New York.

Orange County - The Town of Chester Planning Board, as lead agency, has determined that the proposed Pomegranate Solutions, LLC will not have a significant adverse environmental impact. The action involves the construction of new 110,000 square foot light industrial building consisting of approximately 8,000 square foot of office space. The building will be served by private well and septic system. Two access points are proposed to Davidson Drive. The project site consists of 8.73 acres on four parcels which are to be combined as part of the proposed Action. The project is located on Davidson Drive, west of Bellvale Road, in the Town of Chester, New York.

Rockland County - The Town of Ramapo Planning Board, as lead agency, has determined that the proposed Shoppers Haven Subdivision and Site Plans will not have a significant adverse environmental impact. The action involves a three lot subdivision of 8.14 acre parcel in the CS Zoning District comprised of the three tax lots above, and containing an existing commercial building. Site plans propose 117,964 square foot of new retail/office development, accessory parking and other improvements on two new lots.

1) Lot #1: A new 2 story building along Route 306. 1st Floor: Retail, 2nd Story: Office, Basement: accessory storage (15,829 square foot)
2) Lot #2: Existing 2 story Supermarket, Retail, and accessory storage.
3) Lot #3: An addition to the existing building forming an "L" near to the southern property line.

Additional uses will include Local Convenience Commercial, Retail, Office, and Accessory Storage.

The project is located at 27 Orchard Street in Monsey, Town of Ramapo, New York.
