Project Description:

The Department has made a tentative determination to approve an application for the drainageway improvements within the Town owned Brush Mountain Park and adjacent properties to reduce floodflow within the unnamed tributary to the South Branch of Smokes Creek. The project will disturb .22 acres of the New York State Freshwater Wetland BU-12 and .39 acres of 100 foot regulated adjacent area. Mitigation will include tree and shrub plantings around the project perimeter, that will include 44 trees and 50 shrubs. With mitigation the project meets the Department's Part 663 compatibility and weighing standards. The project is located on 4250 California Road and 0 Bussendorfer Road in the Town of Orchard Park. As a tentative determination, the Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of an activity for which a permit is sought.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has received an application for the continued withdrawal of up to 42,300 gallons per day (GPD), which is the current maximum daily withdrawal of 35,250 GPD plus a 20% operational buffer, from a manmade reservoir pond at the facility. The water withdrawn is utilized for the irrigation of the Ironwood Golf Course. The golf course has been in operation since 2003. The Department is seeking public comment prior to making a final decision on permit issuance.
