Public Notice

The New York State Department of Environmental Conservation (NYS DEC) has received a Brownfield Cleanup Program (BCP) application from Mike Keegan and Mary Keegan for a site known as Former Nathan's Waste and Paper Stock, site ID #C429012. This site is located in the City of Amsterdam, within the County of Montgomery, and is located at 111 Erie Terrace.

What is the Brownfield Cleanup Program?

New York's Brownfield Cleanup Program (BCP) is designed to encourage private-sector cleanups of brownfields and to promote their redevelopment as a means to revitalize economically blighted communities. The BCP is an alternative to "greenfield" (land not previously developed or contaminated) development and is intended to remove some of the barriers to, and provide tax incentives for, the redevelopment of brownfields. Since its inception (2003), the BCP has catalyzed the cleanup of more than 300 contaminated sites statewide and incentivized redevelopment. There are more than 350 active sites in the BCP.

Amended Negative Declaration

Albany County - The New York State Office of General Services (NYS OGS), as lead agency, has determined that the proposed Empire State Plaza (ESP) Central Air Conditioning Plant will not have a significant adverse environmental impact. The action involves the construction of the Empire State Plaza Cooling Water Intake cylindrical wedgewire screens which is anticipated to begin in 2021. The contract has been awarded. Input on the design from the bidders has led the NYS OGS to consider some design changes that require permit modification from the New York State Department of Environmental Conservation (NYS DEC) for Section 401 Water Quality Certification, re-authorization of Nationwide Permits Nos. 3 and 7 from the United States Army Corps of Engineers (US ACE) and re-evaluation and approval of the Coastal Zone Consistency Determination from the New York State Department of State (NYS DOS). None of the proposed changes in design/construction methods are anticipated to have any significant adverse impacts. However, given the sensitivity of the environment in which the design changes will occur (Hudson River estuary) and the need for the permit modifications, the NYS OGS, acting as Lead Agency for the SEQR process, has determined that an Amendment of the Negative Declaration, issued June 22, 2018, is required to properly address the changes in the project and document all the potential impacts of these changes.

The two design changes that warrant further documentation include a revised Bypass Pumping Layout and a revised Turbidity Curtain layout with the use of temporary support piles. Each of these changes involves in-water work not discussed in the previous SEQR documentation.

The project is located as follows, the Intake is on the west side of the Hudson River to the south of Jennings Landing, the outfall- is on the west side of the Hudson River on the north end of Broadway in the City of Albany, New York.

Negative Declaration

Montgomery County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Route 10 Preventative Maintenance Paving will not have a significant adverse environmental impact. The action involves a preventative maintenance paving project that includes roadside safety elements such as drainage structure repair, sign replacement, guiderail extension and limited tree trimming. The objectives for this project include correcting pavement deficiencies and roadside elements that will extend the useful life of the highway and maintain it in a structurally sound condition. The project is located along Route 10 in the Village of Canajoharie, New York

Montgomery County - The Town of Glen Planning Board, as lead agency, has determined that the proposed Pilot Travel Center will not have a significant adverse environmental impact. The action involves the construction of a Pilot Travel Center on 17 ± acres with fueling stations for cars and trucks, a travel center building with a drive thru restaurant and truck service center. The project is located at 164 Riverside Drive in Fultonville, Town of Glen, New York.

Schenectady County - The Town of Duanesburg, as lead agency, has determined that the proposed #20-17 will not have a significant adverse environmental impact. The action involves a 3 lot Major Subdivision under section 3.5 of the Town of Duanesburg Subdivision Ordinance. The project is located at 1756 McGuire School Road in the Town of Duanesburg, New York.

Positive Declaration

Albany County - The Town of Bethlehem Planning Board, as lead agency, has determined that the proposed Albany Port District Industrial Park-Marmen/Welcon Offshore Wind Manufacturing Plant Site Plan may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a 604,000 ± square foot offshore wind tower manufacturing facility spread out over 5 separate buildings. The project also includes a 500 linear foot wharf along the Hudson River to ship completed tower sections. Tower production will occur within 4 buildings (buildings A-D) located on the Port Expansion property located in the Town of Bethlehem, New York. The 5th building (building E) is located at 700 Smith Boulevard within the existing Port District in the City of Albany, New York.
