Negative Declaration

Fulton County - The Town of Johnstown Town Board, as lead agency, has determined that the proposed Amendment to Solar Farm Law will not have a significant adverse environmental impact. The action involves the adoption of a Local Law to repeal and replace Local Law 1 of 2015 by which the Town created its Solar Farm Law. While the mechanism is "repeal and replacement" of Local Law 1 of 2015, the net effect is relatively minor amendments to the prior Law, principally to minimize the zoning districts in which new Solar Farms may be created. Pursuant to Local Law 1 of 2015, Solar Farms were permitted with Special Use Permit in all zoning districts throughout the Town. Under the new Local Law, they are allowed, subject to Special Use Permit, in three zoning districts - the RA, AUZ and M-1. The project is located throughout the Town of Johnstown, New York.
