Project Description:

The Department has received a request to renew a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air Title V Permit, at the facility located at Utica Station, 1103 Higby Road, Frankfort, NY 13340, in Herkimer County.

The Department has made a tentative determination, subject to public comment or other information, to approve the application of the Utica Station renewal of its Title V Permit. This draft permit renewal would allow for the continued operation of existing infrastructure and does not include any new, expanded or modified operations. The operations covered by the draft permit include the transmission of natural gas along the natural gas pipeline.

The facility was recently transferred from Dominion Transmission Inc. to Eastern Gas Transmission and Storage, Inc. The renewal of the Title V Permit allows the operations of emission units 0-0000A 0-0000B, which includes three Copper GMVC internal combustion engines, two Cooper GMVC-6 internal combustion engines, one Cooper GMVR-10 internal combustion engine, and one Cooper GMVH-10 internal combustion engine. All engines are subject to, and meet the requirements of 6 NYCRR Part 227 NOx RACT following the information as described in a table submitted in the approved Compliance and Operating Plan submitted in May 2004.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. The draft permit with all conditions is available for review in the Region 6 NYSDEC office in Utica, NY.

Project Description:

Repair of previously constructed wall and two (2) deflection vanes at the base of Hilltop Park bank and within the bed and banks of Moyer Creek. Total impacts will be 180 linear feet of stream bed and banks with 131 cubic yards of fill placed below the mean high-water mark of Moyer Creek. Work will be conducted in the dry with a temporary stream crossing placed across the stream for construction access.

Stabilize undercut stone wall along Moyer Creek near Manor Apartments with concrete knee wall, east of Litchfield Street in the Village of Frankfort. Stabilize stream bank upstream and downstream of existing wall with heavy stone fill. Total disturbance to the bed and banks of Moyer Creek will be 115-linear feet with 76 cubic yards of fill being placed below the mean high-water mark.
