Project Description:

The Department has received a request for a new air permit to operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law a State Facility Permit, subject to public comment or other information, for the facility that is located at FE Hale Manufacturing Co, Town of Schuyler in Herkimer County in New York State. The exact location is at 11206 Cosby Manor Road in Utica, NY. This facility is engaged in the manufacture of institutional wood furniture and cabinetry. The Standard Industrial Classification representative of this facility are 2521 (Wood Office Furniture). With respect to air pollution regulation, the activities of concern at FE Hale are the surface coating of wood surfaces and the operation of a wood dust collection system. The facility has elected to cap VOC emissions below the Major Source Threshold for the purpose of avoiding Title V Permitting. The facility operates an air pollution control device prior to each regulated atmospheric emission point. The facility has addressed all current requirements of the NYS Climate Leadership and Community Protection Act (CLCPA).

The draft permit with all conditions is available for review in the Region 6 NYSDEC sub-office in Utica, NY.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

DEC received an application for a State Pollutant Discharge Elimination System (SPDES) permit modification for the upcoming improvements to the village's wastewater treatment facilities. The project scope includes a new influent pump station, new non-mechanical screen, new generator and transfer switch, new chemical feed pumps, new control system, new effluent outfall, conversion of the existing outfall into collection main to new pump station, demolition of old influent structure and imhoff tank, removal of underground fuel tank, mechanical louver repairs, roof repairs, and clarifier inspection and equipment repair/replacement.

The proposed scope necessitates a modification to the issued SPDES permit. DEC made a tentative determination to approve the modification and drafted a modified permit. The details of these changes are specified below and included in the draft permit:

  • The permit forms and general conditions have been updated;
  • Modified the Flow monitoring location from effluent to influent;
  • Pump Station Emergency SSO removed from permit;
  • Footnotes have been updated;
  • Added low-level mercury minimization program language;
  • The monitoring locations page has been updated and a facility layout diagram has been added;
  • The "Recording, Reporting, and Additional Monitoring Requirements" page has been updated.
