Project Description:

The New York State Department of Environmental Conservation (DEC) is proposes to modify the State Pollutant Discharge Elimination System (SPDES) Permit NY0036706, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

This is a municipal facility that receives flow from domestic users. The treatment plant provides secondary treatment for a design flow of 1.7 mgd. Treatment consists of screening, grit removal, activated sludge, aeration tanks, final clarifers, phosphorus removal, and UV disinfection. Outfall 001 is the primary outfall and receives all available treatment, Outfall 01A is an internal outfall that consists of discharge from stormwater holding tanks, and is treated and discharged through Outfall 001. Outfall 003 is a combined sewer overflow (CSO) and receives screening only. Treated wastewater discharge is to the La Chute River, a class C water. The following changes to the permit are proposed: Changes in toxic classification; Updated latitude and longitude coordinates; Change in classification for La Chute River to C; New summary of additional outfalls page; Updated definitions page, monitoring locations page, and general requirements; Updated Best Management Practices for CSOs; Updated CSO Long Term Control Plan; Removed mini-industrial pretreatment program requirements based on permittee's request; New stormwater No Exposure Certification requirement; New Mercury Minimization program. Changes made to Outfall 001 include addition and/or removal of monitoring and sampling requirements for specific parameters. Outfall 01A (previously 002) changes involve renaming of the outfall and removal of monitoring for specific parameters, and also include a new footnote requiring sampling and reporting once per day of event, within the first two hours of discharge. Changes to Outfall 003 (CSO) include the removal of monitoring requirements for specific parameters; The Schedule of Compliance has been updated; The Schedule of Additional Submittals has been updated with the removal of sampling for specific parameters and addition of new submittal items.

As a result of the EBPS full technical review, a new five-year term is proposed. The permit includes updated forms and the latest general conditions. Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.
