Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY0022357, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

This is a publicly owned treatment works facility that receives flow from domestic users. Wastewater consists of treated sanitary. The facility provides secondary treatment with a design flow of 0.98 MGD. Treatment consists of grit removal, primary clarifier, sand filtration, post aeration and UV disinfection. Sludge is anaerobically digested and hauled to landfill. The following changes to the permit are proposed: General updates were made to page 1, the permit limits definition page, and discharge notification requirements page. Changes were made to the permit limit table for Outfall 001 and include - New: year round effluent limit, and monthly and 7-day average for Carbonaceaous Biochemcial Oxygen Demand (CBOD5); Winter Ultimate Oxygen Demand (UOD) limit; Year round Total Kjeldahl Nitrogen (TKN) monitoring; Total Nitrogen annual loading limit; Monthly average concentration limit for Total Phosphorus; 12 month rolling average concentration limits for Mercury and Total Copper; Total Residual Chlorine (TRC) limit. Decrease: Daily maximum winter limit for settleable solids; Summer UOD limit; Summer and winter ammonia limits;Total phosphorus annual loading limit; Increase: Daily Minimum Dissolved Oxygen (DO) concentration from summer and winter limit to year round. Change: Reporting for ammonia to as N; Consolidation of Chesapeake Bay Total Maximum Daily Load requirements into a single permit limits page; Start of disinfection season to May 1. Remove: UOD influent sampling; Adjusted Total Nitrogen loading limit. A Schedule of Compliance has been added with final effluent limits for ammonia, total phosphorus and copper, and the Schedule of Submittals has been updated.

As a result of the EBPS full technical review, a new five-year term is proposed. The permit includes updated forms and the latest general conditions. Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

The proposed action is subject to CP-29. An enhanced public participation plan was submitted by the applicant and has become part of the complete application.

Project Description:

The Village of Mayville has applied to the Department to add the withdrawal of 236 gallons per minute from new groundwater well No. 4 to its existing water supply system. Well No. 4 will improve the seasonal well capacity needs of the Village's system and address water supply concerns with existing wells. Well 4 is located at the new Maple Drive East Well site within the Village of Mayville. Existing Well No. 2 will be decommissioned as part of this action. The Department has made a tentative determination to approve this application and is seeking public comment prior to making a final decision on permit issuance.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
