Project Description:

The existing life of mine (LOM) is 47.9 acres with a 28.3-acre permit term area (PTA) and is located at 320 Industrial Park Rd in the Town of Horseheads, Chemung County. The applicant proposes to add 4.3 acres to the current LOM. The 4.3 acres are divided into 3 distinct areas on the property. Additionally, 4.3 acres would be removed from the existing PTA and another 4.3 acres would be added to the PTA. The resulting LOM would be 52.2 acres with a PTA of 28.3 acres. As is permitted in the current LOM, mining below the water table Is proposed in the new LOM. No other modifications are proposed at this time.

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

Project Description:

Install a 5-megawatt solar photovoltaic ground-mounted array on trackers. This will include four equipment pads and gravel paths for access. The project will change the property from agricultural use to a meadow/grassland. Approximately 1.35 acres of impervious surfaces will be created. There will be approximately 505 square feet of temporary impacts to streams and wetlands on the site. There will be an additional 796 square feet of permanent impacts to wetlands from the construction of an access road. The project site contains no NYSDEC regulated Freshwater Wetlands or NYSDEC protected streams, only federally protected wetlands and streams. The Project site is approximately 0.10 mile off of Creek Road, approximately 0.5 mile southwest of the intersection of School St. and Creek Road in Mt. Morris, Livingston County.

Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Project Description:

The applicant is proposing reconstruction and rehabilitation measures for the Sutter's Marina Improvements Project under the Lake Ontario Resiliency and Economic Development Initiative (REDI). Proposed changes to prevent future flooding of Marina structures and ensure the Marina is operable at varying water levels include demolishing the main operations building and constructing a new building within the existing footprint, constructing a new concrete patio within the footprint of the existing deck system, and removing the existing fuel shed/concrete pad and construct a new concrete pad. Additional proposed improvements include raising the elevation of the 1,700 square feet of parking area, replacing a boat ramp, and the placement of rip-rap along the shoreline north and east of the main operations building. All the proposed work is in previously disturbed areas within the regulated 100-foot adjacent area of Irondequoit Bay, a State regulated freshwater wetland. There is 15 linear feet of fill proposed below the Mean High Water elevation of 247.3 feet IGLD 85. Proper sediment and erosion controls will be used to protect the water quality of the Bay during construction.

For REDI project MO-49 (Lake Shore Storm Sewers), the applicant is proposing to construct sump pump pits in 6 locations with in-line check valves to allow flood waters to be pumped off roadways to improve stormwater drainage in low-lying areas. The project will reuslt in the following impacts: a net 30 CY of excavation in regulated Freshwater Wetlands Adjacent Areas for NYSDEC regulated Freshwater Wetlands PM-1 and PM-2; 1 CY (net zero) of excavation and fill within the regulated Freshwater Wetlands; 10 CY of excavation and fill (net zero) below Mean High Water. The project areas are along the Lake Ontario shoreline in the vicinity of West Beach Rd, North Avenue, Ferguson Dr, Zellweger Beach Rd, Alder Beach Rd, and Lake Side Blvd, in the town of Parma, Monroe County.
