Negative Declaration

Orange County - The Town of Wallkill Planning Board, as lead agency, has determined that the proposed Sky Solar - Tice 1 will not have a significant adverse environmental impact. The action involves the granting of a Special Use Permit and Site Plan Approval by the Town of Wallkill Planning Board for the construction and operation of a Solar Farm / Solar Power Facility with a 13.64 acre solar array. The project is located on Tice Lane in the Town of Wallkill, New York.

Orange County - The Town of Wallkill Planning Board, as lead agency, has determined that the proposed Galleria Residences - 224 Unit Apartment Complex will not have a significant adverse environmental impact. The action involves the development of a 224 unit apartment complex on 4.92 ± acres of land, with 357 parking spaces, and pedestrian walkways to an existing shopping mall and train station. To construct the project, the Applicant needs to obtain a Planned Residential District zoning designation from the Town Board for the project site, site plan approval from the Planning Board, and other approvals/ permits from other agencies. The project is located at the intersection of Galleria Drive and Smith Road in the Town of Wallkill, New York.

Orange County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Speyside Quarry, Modification will not have a significant adverse environmental impact. The action involves an existing, operating, permitted mine. The applicant is currently permitted to mine and process sand, gravel and sandstone from a maximum of 61.4 acres (North Quarry) of a 97 acre total life of mine (LOM) boundary, situated on 198 acres controlled by the owner. Currently the approved final elevation at the bottom of the North Quarry pit is 290 foot above mean sea level (AMSL) and the reclamation plan is an approximately 20 acre lake with a surface elevation approximately 384 foot AMSL. The final elevation of the North Quarry is proposed to be extended to 190 foot AMSL. Additional pumping of groundwater is proposed to dewater the deeper depth and additional discharge of that groundwater to a unmapped tributary of Woodbury Creek is proposed. This action does not include any work in or disturbance to the South Quarry. The project is located at 911 NYS Route 32 in Central Valley in the Town and Village of Woodbury, New York.

Rockland County - The Town of Ramapo Planning Board, as lead agency, has determined that the proposed 19 Old Nyack Turnpike Subdivision will not have a significant adverse environmental impact. The action involves a subdivision which would be for the creation of four lots from two existing lots. Each lot would have a two-family residence. The project is located within the R-15A zoning district. All variances granted on 7/16/20 by Town Zoning Board of Appeals under XBA 4837. All parcels will be served by public water and public sewer. The project is located at 17 - 19 Old Nyack Turnpike in the Town of Ramapo, New York.

Sullivan County - The Town of Tusten Town Board, as lead agency, has determined that the proposed Adoption of Town Comprehensive Plan will not have a significant adverse environmental impact. The action involves the adoption of Comprehensive Plan to replace the Town of Tusten's Comprehensive Plan of 2007. The primary purpose of the new plan is to chart a course for the community's future by putting forth a series of actions within topics that include Cultural, Historical, and Recreation Resources; Economic Development; Environmental Resources; Land Use; Transportation; and Community Services and Infrastructure. The plan will meet the needs of addressing growth and change within the town for several years, protecting and promoting the special qualities and resources of the town, and aiding the decision-making process of boards and officials in the town government. The plan is also consistent with many of the principles and actions of county, regional, and state plans, further strengthening consensus of future actions. The plan was developed with opportunities for public input and guided by the town's appointed comprehensive plan committee.. The project is located throughout the Town of Tusten, New York.

Positive Declaration

Westchester County - The City of New Rochelle City Council, as lead agency, has determined that the proposed 2021 Downtown Overlay Zone (DOZ) Amendments may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a proposal to prepare a Supplemental Draft Generic Environmental Impact Statement analyzing amendments to the Downtown Overlay Zones (DOZ) adopted by the City of New Rochelle Council in 2015. Specifically, the Proposed Action involves updates to the Theoretical Development Scenario considered for the DOZ (2020 Modifications) to address the shift in demand away from certain commercial uses and to provide for additional residential and live/work options, as well as retail and restaurant options designed to integrate the outdoors and new outdoor recreational opportunities. The Proposed Action also includes the continuation of the DO Zones to the south and east to allow for development on or near a newly created publicly accessible waterfront. The Proposed Action includes the extension of the DOZ to add approximately 21 acres to the DO Zones through the creation of a new "Waterfront Overlay District" (DO-7 Zone). This would involve the adoption of an amendment to the New Rochelle Zoning Code and Zoning Map, which would apply to twelve (12) contiguous tax lots along the waterfront (four of which are owned by the City). The project is located in downtown New Rochelle, New York.

Notice of Availability of Draft Scope and Public Scoping Session

Orange County - The Town of Goshen Planning Board, as lead agency, has made the Draft Scope for the proposed RDM Route 17M available. The Draft Scope is available from the contact listed below and on line at: http://www.townofgoshen.org/. A public scoping session on the Draft Scope will be held on May 6, 2021 at 7:30 p.m. at the Town of Goshen Town Hall, 41 Webster Avenue, Goshen, NY - unless it must be virtual, information available at: www.townofgoshen.org.

The action involves a proposal by the applicant, RDM Route 17M (a/k/a 2602 Rt 17 Developers, LLC), for a 300,00 square foot warehouse facility, 151 parking stalls, 72 truck loading docks and 31 trailer storage spaces on a parcel located with frontage along New York State Route 17M. The property contains 61.59 ± acres, and is located within the Commercial/Office Mixed-Use (CO) district, and within the Flood Plain and Ponding Area and AQ-6 Overlay Districts. The project is located at 2602 Route 17M in the Town of Goshen, New York.

Notice of Acceptance of Draft GEIS and Public Hearing

Rockland County - The Town of Clarkstown Town Board, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Adoption of the 2021 Town of Clarkstown Comprehensive Plan Update. A public hearing on the Draft GEIS will be held on June 1, 2021 at 7:00 p.m. at the Town of Clarkstown Town Hall, 10 Maple Avenue, New City, NY 10956. Written comments on the Draft GEIS will be accepted until June 11, 2021. The Draft GEIS is available from the Clarkstown Town Clerk's Office & Planning Department; the New City, Valley Cottage, West Nyack, Nanuet Libraries; and on line at: compplan2020.clarkstown.org/public-participation.

The action involves the adoption of the 2021 Town of Clarkstown Comprehensive Plan Update will serve as a guide for land use decisions in the Town of Clarkstown. The Plan is organized around eight themes: Economic Development; Environmental Resources; Health, Safety & Welfare; Historic & Cultural Resources; Housing; Parks, Recreation & Open Space; Transportation and Sustainability & Resiliency. The Plan has been designed to serve as a Generic Environmental Impact Statement under the provisions of the New York State Town Law Section 272(a)(8). The Comprehensive Plan Update recommends changes to the Town of Clarkstown policies, codes and zoning as well as calls for further analysis of land use within specific areas of the Town. The project is located throughout the Town of Clarkstown, New York.
