Negative Declaration

Chemung County - The Town of Big Flats Planning Board, as lead agency, has determined that the proposed 4.98 MW
Solar Farm will not have a significant adverse environmental impact. The action involves the development of a 4.98 MW solar farm covering approximately 22.5 acres on a 64.1 acre parcel in the Town of Big Flats. The project involves the installation of ground mounted photovoltaic panels as well as associated access road, electric utility upgrades and equipment, perimeter fencing, and landscape screening. The project is located in the Town of Big Flats, New York.

Monroe County - The Town of Henrietta Town Board, as lead agency, has determined that the proposed Lehigh Mixed Use Development will not have a significant adverse environmental impact. The action involves the development of a 350 ± residential units with 500,000 square foot of commercial/industrial space on the southeast corner of the parcel. The project is located at the northeast corner of Lehigh Station Road and East River Road in the Town of Henrietta, New York.

Steuben County - The Town of Dansville Planning Board, as lead agency, has determined that the proposed Community Power Group, LLC-Marcus and Nue Solar Farms will not have a significant adverse environmental impact. The action involves the construction and operation of two 5-megawatt ground-mounted solar farms and associated electrical appurtenances. The combined solar photovoltaic (PV) systems are proposed for installation on 50 acre within a combined approximate 145 acre agricultural site. The solar array will be surrounded by a 6 foot high security fence, landscape screen facing State Route 36 and a site access road connecting to State Route 70. The project is located at 9350 and 9451 State Route 36 in Arkport Town of Dansville, New York.

Positive Declaration

Monroe County - The Town of Henrietta Town Board, as lead agency, has determined that the proposed Solar Energy System and Incentive Zoning Amendments may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a proposal by the Town of Henrietta to modify its current Solar Energy System regulations to align with the Town's Comprehensive Land Use Plan goals by adding criteria for approval of solar projects under different existing land use conditions and locations in the Town. The purpose is to place greater emphasis on the protection of prime farmland and farmland soils, but still allow solar energy systems in farming areas to support farm incomes and sustainable agriculture. The new regulations establish permitting criteria for small, medium and large-scale solar energy systems.

The Town is also proposing establishing Incentive Zoning and modifying its current Open Space Incentive Option to further the goals of the Comprehensive Land Use Plan focused on the preservation and conservation of open space and active agriculture especially in the Rural Residential Zoning District in the southern half of the Town. The regulations promote conservation of open space via conservation easements, use of conservation subdivision design, reuse of vacant and underutilized properties, providing for public infrastructure in neighborhoods, and protecting historic resources.

The project is located throughout the Town of Henrietta, New York.

Notice of Acceptance of Draft SGEIS and Public Hearing

Monroe County - The Town of Henrietta Town Board, as lead agency, has accepted a Draft Supplemental Generic Environmental Impact Statement on the proposed Solar Energy System and Incentive Zoning Amendments. A public hearing on the Draft SGEIS will be held on April 14, 2021 at 7:00 p.m. at the Town of Henrietta Town Hall. Written comments on the Draft SGEIS will be accepted until April 25, 2021. The Draft SGEIS is available from the Town of Henrietta Town Clerk's Office, 475 Calkins Road; the Town Public Library, 455 Calkins Road; and on line at: https://www.henrietta.org.
