Negative Declaration

Livingston County - The Livingston County Water and Sewer Authority, as lead agency, has determined that the proposed Lakeville Wastewater Treatment Plant (WWTP) Improvements will not have a significant adverse environmental impact. The action involves upgrading the Lakeville WWTP to meet the requirements of the 2013 SPDES permit and the upcoming TMDL for the Genesee River watershed. Upgrades include addition infrastructure need for ammonia and phosphorus reduction in the effluent as well as improvements to the existing processes. New structures will be constructed at the WWTP as a part of these upgrades including a new secondary clarifier, new bio-tower, and a new chemical feed building.

2020 Revision:
The additional updates to the WWTP include the following: Influent building improvements, Primary and Secondary Clarifier upgrades, new Ultraviolet Disinfection system, Pump Station improvement, Sludge handling process upgrades, new Sludge Storage building, site security upgrades, and various additional site improvement.

The project is located at 1997 D'Angelo Drive in Lakeville, Town of Livonia, New York.

Monroe County - The Village of Honeoye Falls Zoning Board of Appeals, as lead agency, has determined that the proposed Subdivision of Wolfsberger Park will not have a significant adverse environmental impact. The action involves the subdivision of approximately 72 acres of property for the purposes of building 118 dwelling units. The project is located on the east side of North Main Street (NYS Route 65), south of Pride Street, in the Village of Honeoye Falls, New York.

Monroe and Orleans Counties - The Town of Kendall Town Board, as lead agency, has determined that the proposed Wastewater Infrastructure Project will not have a significant adverse environmental impact. The action involves a proposal for the creation of a sanitary sewer district and developing plans for installation of wastewater infrastructure along the Lake Ontario Shoreline through a portion of the Towns of Kendall and Hamlin. The Town of Kendall will act as Lead Agency and is applying for funding through the New York State Resiliency and Economic Development Initiative (REDI). As currently proposed, the project includes a total of 80,000 ± linear foot of sewer main along the road rights-of-way of Thompson Drive, Frontage Road, Knapp Shore, Edrose Shore, Lomond Shore West, Banner Beach Road, Lakeland Beach Road, Bald Eagle Drive, Norway Heights, Norway Road, and the Cottages at Troutburg in the Town of Kendall and Beachwood Park Road in the Town of Hamlin. Assuming that construction will disturb an area 24 ± foot in width along the length of the project, the total area affected by the project is 44 ± acres. The purpose of the project is to replace inadequate or failing septic systems with a state-of-the-art sanitary sewer system in order to improve water quality and to address public health concerns. Inadequate or failing private wastewater systems have resulted in untreated or partially treated sewage reaching the ground surface, and groundwater or surface water bodies, including Lake Ontario and nearby creeks and wetlands. The proposed action also includes execution of a Inter Municipal Agreement between the Town of Kendall, Town of Hamlin, Monroe County, Monroe County Pure Waters, and several other entities. The project is located in the Towns of Kendall and Hamlin, New York.

Seneca County - The Town of Tyre Town Board, as lead agency, has determined that the proposed Zoning Law Amendments will not have a significant adverse environmental impact. The action involves the amendment of the Tyre Town Code. The proposed action is purely administrative. The project is located throughout the Town of Tyre, New York.

Steuben County - The Board of Education (BOE) of the Jasper-Troupsburg Central School District, as lead agency, has determined that the proposed 2021 Capital Improvement Project will not have a significant adverse environmental impact.

The proposed 2021 Capital Improvement Project (CIP) for the 2021 Planned Facilities Upgrade at the Jasper-Troupsburg Central School District includes interior and exterior improvements within the Elementary School building and campus, as well as interior and exterior improvements within the Junior/Senior High School (High School campus) school building and associated campus facilities including a bus garage, bus garage storage, athletic fields, and concession areas. With regard to interior improvements, most interior improvements planned would have minimal environmental impact. Details regarding campus improvements are detailed below.

Exterior building improvements at the Elementary School include reconstruction of Kindergarten wing entrance and replacement of roofing from 1998 and older. Site work at the Elementary School campus includes upgrades to site lighting (replace existing lighting with LED fixtures and add lighting at the bus loop), new bus loop at front of building (0.31 ± acres of ground disturbance), new parent drop-off circle and expanded south parking lot (0.02 ± acres of ground disturbance), and sidewalk replacement at upper level parking area and back entry. Additionally, an existing underground fuel oil tank will be removed per New York State Department of Environmental Conservation (NYS DEC) guidelines and replaced with a new 30,000 gallon underground propane tank (0.03 ± acres of ground disturbance). Interior building improvements at the Elementary School include replacement of failing doors, security upgrades (key fob system, grand master key system, lock-down capability, and security cameras), floor replacement in certain areas, upgrade to elevator control, replacement of IT wiring throughout building, and the addition of booster pumps to the water system.

Exterior building improvements at the High School include reconditioning of metal roof at gymnasium entrances and replacement of roofing older than 1998. Site work at the High School campus will be limited to removal of an existing underground fuel oil tank per NYS DEC guidelines, which will be replaced with a new 30,000 gallon underground propane tank (0.03 ± acres of ground disturbance). In addition, replacement-in-kind of a cast iron sanitary main with PVC is planned (0.01 ± acres of ground disturbance). Interior building improvements at the High School include lighting upgrades, security upgrades (including key-fob system, grand master-key system, and lock-down capability), replacement of glass block windows at Upper Auditorium, replacement in-kind of classroom's windows, replacement of locker room doors, re-sealing of windows and doors throughout building, replacement of gym bleachers, and upgrades to PA system and IT wiring. Additionally, sump pumps will be replaced by the main electrical room and existing boilers will be maintained as necessary.

Site work proposed at the Bus Garage includes the addition of a bus wash bay, associated services and paving (0.1 ± acres of ground disturbance) and replacement of an oil water separator. The proposed bus wash bay will generate additional liquid waste (wash bay wastewater) that will be discharged through existing public drainage infrastructure. The District's Athletic Fields are also located on the same tax parcel as the Bus Garage. Site improvements proposed at the Athletic Fields and concession area only include replacement of existing field lighting with LED fixtures. Interior building improvements proposed at the District's Bus Garage include replacement of overhead doors and associated safety systems and HVAC upgrades.

The project is located throughout the Jasper-Troupsburg Central School District in Jasper and Troupsburg, New York.

Notice of Availability of Draft Scope

Orleans County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has made the Draft Scope for the proposed Shelby Crushed Stone Medina Pit available. The Draft Scope is available from the contact listed below and on line at: https://www.shelbystone.com/. Written comments on the draft scoping document are being accepted and must be submitted by mail or e-mail to the contact person listed below by April 29, 2021.

The action involves a proposal by Shelby Crushed Stone, Inc. to expand its currently-permitted limestone/dolostone mine of approximately 106 acre of life-of-mine area, located in the Town of Shelby. As proposed, an approximately 14.8 area expansion area is proposed to be used for the excavation of consolidated bedrock material. The expansion area consists of 8.69 acres of state and federal jurisdictional wetlands and 6.11 acres of state regulated 100 foot adjacent area. No changes to the method or manner of mining are proposed. The project is located at 10830 Blair Road in the Town of Shelby, New York.
