Project Description:

Hume - Wiscoy Solar I, LLC and Hume - Wiscoy Solar II, LLC (Applicants) propose to construct a new solar photovoltaic facility encompassing approximately 60.8 acres in the Town of Hume, Allegany County. A Part 182 Listed Species Incidental Take Permit is necessary for potential take of Short-eared Owl (NYS Endangered Species) due to diminishment of overwintering habitat within the proposed project area.

A Net Conservation Benefit Plan has been developed to avoid, minimize, and mitigate this adverse impact. This plan includes management of a mitigation area over a total of 18 years, where a 30.4-acre hayfield is maintained, invasive species removed and replaced with native species, and mowing of the area specifically timed to ensure suitable overwintering habitat, with annual monitoring conduced for 6 years after project construction. The project is proposed at the facility location listed above, with mitigation area located adjacent to the south and east within the project parcel.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Allegany County Industrial Development Agency

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 25, 2021.
