Project Description:

The applicant proposes a new discharge of up to 100 MGD of treated sanitary and stormwater from a screening and disinfection treatment satellite facility, located in Lincoln Park. The facility will screen and disinfect for wet weather flows associated with the Beaver Creek sewershed. The applicant proposed to construct the satellite treatment facility as per the requirement under the Albany Pool Combined Sewer Outfall Long Term Control Plan which was created as a response to an administrative Consent Order dated January 13, 2013 (CO 1-20170626-244).

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.

Availability of Application Documents:

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness. As part of the plan, a document repository has been established near the project area that contains application and project related materials. Information on the repository location and other outreach components of the plan is available from the identified DEC contact.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Albany Water Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

The proposed action is subject to CP-29. An enhanced public participation plan was submitted by the applicant and has become part of the complete application.

Project Description:

The applicant proposes to renew and modify the life-of-mine area of an existing 5.9 acre life of mine bluestone mine by adding additional acreage for a total life of mine of 20 acres. Blasting and periodic crushing and screening of material is authorized at this site. The project is located on the East side of Sands Creek Road (CR 67) approximately 8/10ths of a mile north of the intersection of Dry Brook Road, Town of Tompkins, Delaware County, NY.
