Project Description:

The applicant proposes the take of 34.45 acres of occupied habitat for northern harrier (Circus hudsonius, State-listed threatened) and short-eared owl (Asio flammeus, State-listed endangered), associated with the construction of a 2.5 megawatt ground-mounted solar array and associated access roads and infrastructure located at 833 Pulaski Highway in the Town of Goshen. While the proposed project footprint is 18.97 acres, the subtraction of this amount of habitat from the overall amount available at the site (34.45 acres) would result in an amount of habitat at this site below the minimum needed to support these species. Therefore, the project would result in a take of 34.45 acres of habitat.

A Net Conservation Benefit for both species will be achieved through the establishment of a 41.57-acre conservation lease of grassland habitat, located at 207 King Road in the Town of Wallkill. This parcel will be managed to maintain the size and quality of grassland habitat for the life of the solar project (a period of no less than 25 years), and winter raptor surveys will be conducted for two years at both sites. In addition, avoidance measures will be implemented to avoid adverse impacts to the species during construction of the project.

The Department has prepared a draft permit and has made a tentative determination to renew the Title V Facility Permit to Algonquin Gas: Stony Point Compressor Station. The Algonquin Gas: Stony Point Compressor Station is a compressor station for the transmission of natural gas located in the town of Stony Point, Rockland County, New York. This natural gas compressor station is one of many that span the nationwide pipeline grid that provides the necessary pressure increase to maintain flow of natural gas.

The facility primarily consists of the following permitted emission sources (ES): Two (2) Solar Taurus 60-07802S3 gas-fired turbines (ES-00081 & ES-00082); Three (3) Solar Mars 100-16002S4 15,900 HP (ISO) natural gas fired turbine-driven compressor units (ES-00071, ES-00009, ES-00010); Two (2) exempt Waukesha VGF24GL (585 bhp) natural gas fired emergency generators (ES-EG001 and EG002); Fugitive emissions from pipeline components and gas release (ES-E0001) miscellaneous natural gas fugitive and venting (ES-0001). Other exempt/trivial equipment activities include small combustion equipment (each <1.0 MMBtu/hr), small storage tanks, and truck loading activities. All combustion units utilize pipeline quality natural gas.

The three Solar Mars 100-16002S4 turbines are subjected to a NOx concentration limit of 9 ppmvd at 15% oxygen (O2) during normal operation based on manufacturer guarantee. VOC and CO emissions from the Solar Mars 100-16002S4 turbines are based on the manufacturer's emission rate of 25 ppmv Total Organic Compound (TOC) at 15% O2 and 25 ppmvd at 15% O2, respectively. For PM2.5, the Solar Mars must demonstrate compliance with the EPA AP-42 emission rate of 0.0066 lbs/MMBtu. Performance testing is required once during the term of the permit for VOC, CO and PM2.5 to demonstrate compliance of respective emission rates. The two Solar Taurus 60-07802S3 NOx concentration limits are based on the manufacturer's emission rate of 15 pppmvd (15% O2) during steady state operations. To avoid New Source Review for a major source, emission reduction credits (ERCs) and netting emission limits were established for VOC, PM2.5, NOx and CO during previous permit renewals and modifications.

It should be noted that turbine concentration limits are more stringent than both the NSPS 40 CFR 60 Subpart KKKK (60.4320(a)) limit of 25 ppmvd (15% O2) and the 6 NYCRR Part 227-2.4(e)(1) NOx Reasonable Available Control Technology (RACT) limit of 50 ppmvd (15% O2). During the term of the permit, all turbines will undergo NOx performance testing according to Subpart KKKK regulatory testing procedures and schedules.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
