Project Description:

The Department has made a tentative determination to approve this application for a new permit for an upgraded system discharge of 395 gallons per day of stormwater from containment area and loading and unloading area to groundwater from an Oil/Water Separator system at the applicant's facility located at 14 Jefry Ln. Hicksville, NY 11801. The applicant plans to continue to operate a bulk storage and terminal. Refer to this application by application number listed above and SPDES number, NY0280143.

The proposed discharge is located within an area designated as a sole source aquifer. The following water purveyors have been identified as having service areas located within a 3 mile radius of the applicant's facility: Jericho Water District, Westbury Water District, East Medow Water District, Bowling Green Water District, Hicksville Water District, Levittown Water District, Bethpage Water District, Plainview Water District, Farmingdale, Water District, and South Farmingdale Water District.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

The applicant plans to continue to operate a car wash facility. The proposed discharge is located within an area designated as a sole source aquifer. The following water purveyor has been identified as having service areas located within a 3-mile radius of the facility: Suffolk County Water Authority.
