Project Description:

The Department has prepared a draft permit and made a tentative determination to issue a renewed and modified Title V Air permit for the National Fuel Gas Supply Corporation Independence Station Facility. The facility is a natural gas storage facility consisting of four natural gas fired stationary reciprocating internal combustion compressor engines, two rated at 1000 HP and two rated at 1500 HP, one 302 HP Kohler Model 200REZXB spark ignition emergency generator which, as the only permit modification, replaced one 200 HP emergency generator which was decommissioned on September 12, 2018, and two natural gas triethylene glycol (TEG) dehydration units. Other exempt equipment includes a boiler, hot water heater, parts washer, and nine tanks. The dehydration units use a regenerative glycol system to remove water that accumulates in the natural gas during underground storage at the facility. The dehydration units are subject to 6NYCRR Part 212 which requires process emissions to meet air pollution control standards. The compressor engines are subject to the nitrogen oxides (NOx) emission limit for lean burn spark ignited natural gas fired stationary internal combustion engines. The NOx limit is 1.5 grams per brake horsepower-hour per 6 NYCRR Part 227-2.4(f)(1). Source performance testing performed in 2019 has confirmed compliance with the limit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Department has received and made a tentative determination to approve an application for the relocation of the river water intake structure and pump station used by PeroxyChem, LLC for cooling water at its chemical production plant at 35 Sawyer Avenue in Tonawanda. The proposed location of the relocated outfall is approximately 500 feet further downstream on the east shoreline of the Niagara River. The existing intake structure is on property owned by Huntley Power LLC and PeroxyChem will no longer have access to this intake due to the closure of the Huntley facility, therefore the intake must be relocated. The proposed pump station will be located on a parcel of land at the northwest corner of the Huntley property which will be transferred to PeroxyChem LLC. The work area in the Niagara River will be dewatered through the use of a steel sheetpile cofferdam to protect water quality. The intake facility will be constructed within the cofferdam and will be comprised of: a 30-inch diameter intake pipe extending approximately 80 feet into the Niagara River and protected with riprap and encased in concrete; a concrete river water intake structure at the terminus of the intake pipe to house 4, 24-inch diameter intake pipes each equipped with 0.75-mm wedgewire screens and an airburst system; a bedload deflector located immediately upstream of the intake structure; and 5 timber dolphin piles surrounding the intake structure. Fill below mean high water includes approximately 7.4 cubic yards (cy) of concrete, 146 cy of crushed stone bedding, and 88 cy of riprap.

In addition to the Protection of Waters permits referenced above, this action will also involve a modification to the water withdrawal permit issued to PeroxyChem LLC (9-1464-00040/00111) to reflect the relocated outfall. There will be no change in the amount of water authorized for withdrawal and the screens on the new intake will be properly sized to comply with the Best Technology Available requirements for impingement and entrainment.

As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.

Evaluation using a Structural-Archaeological Assessment Form or other information has concluded that the proposed activity will not impact registered, eligible or inventoried archaeological sites or historic structures.

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
