Project Description:

The applicant proposes to apply the selective herbicide Procella COR for the control of Eurasian Milfoil in Kinderhook Lake, a Class 1 freshwater wetland lake (K-109). The proposal includes treatment of 160 acres of the 350-acre waterbody with Procella COR at an application rate of 6.4 to 9.6 ounces per acre-foot. The total amount of herbicide to be used in 2021 will be 36 gallons. These treatments will be done from May until July of 2021 and will be applied sub-surface by an airboat with weighted lines.

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant has applied for a new Water Withdrawal permit for the continued withdrawal of up to 170,000 gallons per day (GPD) of water for irrigation purposes at the Winding Brook Country Club. The facility has been in operation since 1962 and no changes are proposed as part of this application. The Department has determined that the existing withdrawal exceeded the threshold volume established within ECL Article 15, Title 15, and therefore required the facility to obtain a new permit. The applicant proposes to continue seasonally withdrawing water from the existing pond on site, which formed following the historic construction of a dam within an unnamed Class-C tributary to the Kinderhook Creek.

Project Description:

*Continued operation and modification* of an existing 29-acre Life of Mine shale mine for which a previous permit has been issued under Article 23, Title 27, of the Environmental Conservation Law (Mined Land Reclamation) of which 26 acres are authorized to be affected during this permit term.

*The following modifications are authorized by this permit:

  1. The use of an additional crusher and screener at the operation. Therefore, two crushers and two screeners are now authorized for use at the site.
  2. The crushing hours of operation have been increased from 3 days a week for a maximum of eight hours per day to 7AM - 5PM Monday through Friday.
  3. The importation of up to 200 CY of clean, uncontaminated sand and soil to be stockpiled for resale.
  4. The permit term affected area has been increased from 18.2 acres to 26 acres.
