Project Description:

The New York State Department of Environmental Conservation (DEC) has and made a tentative determination to issue and renew a permittee-initiated modification (PIM) to State Pollutant Discharge Elimination System (SPDES) permit NY 0020249. This is a re-notice of a previously issued draft permit based on comments received during the prior comment period.

The following changes are proposed: increase in flow from 0.81million gallons per day (MGD) to 0.95 MGD; added daily maximum flow monitoring; added CBOD5 7-day average limit of 40 mg/l (320 lbs/d); updated CBOD5, UOD, and TSS Loading Limitations Based on 0.95 MGD; added Ammonia (as N) concentration limit for both summer and winter; added Phosphorus limit of 3.0 mg/l; added Temperature Action Level of 70oF; added schedule of compliance for Phosphorus; added short term monitoring for Selenium; added WET testing; permit pages have been revised to reflect current NYSDEC format, nomenclature, and the latest general conditions. The permit will have a new five-year term upon issuance.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The Village of Heuvelton is proposing to install approximately 45,300 linear feet of sewer pipeline and associated vault to convey waste water from the Village to the Waste Water Treatment Plant in the City of Ogdensburg. The project will consolidate the two existing wastewater treatment facilities into one and improve local and regional surface water quality.

The project will require excavating trenches through NYS regulated wetlands and wetland adjacent areas to install the sewer pipe. Excavation will result in 61,520.0 square feet of temporary impacts to the adjacent areas of four NYS regulated wetlands, 80.6 square feet of permanent impacts to the adjacent areas of two NYS regulated wetlands, and 1,379.2 square feet if temporary impacts to one NYS regulated wetland.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Heuvelton Village Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Feb 25, 2021.
