Project Description:

The applicant proposes to encapsulate approximately 1,005 piles at the mooring pier, 206 piles and 20 pile caps at the approach pier, and 66 piles at the fuel pier. The timber fender system along the south side of the pier will undergo in-kind replacement. Additionally, approximately 396 feet of steel sheet pile bulkhead and 43 feet of existing timber crib wall will be repaired. The cribwall repair requires approximately 14.7 cubic yards of fill within tidal wetlands. A mitigation plan to remove approximately 30 cubic yards of remnant concrete seawall is proposed to offset the impact. The project is located at the western terminus of 53rd Street meeting Bay Ridge Channel, 4 Whale Square, Block 803, Lot 150, Brooklyn.

The Department has made a tentative determination to approve this application to modify an existing SPDES permit for a discharge of treated wastewater into the East River (Class I) from a treatment plant at the applicant's facility located at 514 East 60th Street in Manhattan where the applicant currently operates a Steam Plant. This modification will add reverse osmosis (RO) reject water and associated equipment drains/leaks from the reverse osmosis system equipment to Outfall 001 in accordance with the permittee's request. Changes proposed in the draft permit as compared to the currently effective SPDES permit are specified in the fact sheet and in the draft permit. Such changes include formatting changes and the inclusion of short-term high intensity monitoring for hexavalent chromium, total copper, total lead, total nickel, and hardness in the Schedule of Additional Submittals. Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.
