Project Description:

This Department has received a request to renew a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, Air Title V Permit, at the facility located at Tennessee Gas Pipeline Company Compressor Station 245, the facility is located at 457 Burrows Road, West Winfield, NY 13491.

The Department has made a tentative determination to approve the application of the Tennessee Gas Pipeline Company, which provides for the transmission of natural gas along the natural gas pipeline. The renewal of the Title V Permit allows the operations and of emission units R-24502, R-24504, R-24505, R-24506, R-24507 and R-24508 which includes five Worthington UTC internal combustion engines, one Clark TLAD internal combustion engine, two Caterpillar model 3612 internal combustion engines, a Caterpillar model 3516 internal combustion engine for emergency power generation, a Taurus 70 Turbine, and two exempt boilers that were part of the PSD/NSR analysis. All engines and turbine are subject to the NOx RACT requirements of 6 NYCRR 227, and the two Caterpillar model 3612 engines are also subject to 40 CFR 63 Subpart ZZZZ. The turbine is subject to 60 CFR Subpart KKKK and 40 CFR 63 Subpart YYYY. The issuance of this renewal permit is the continued approval of the NOx RACT Compliance and Operating Plan for 6 NYCRR 227-2.5(c) that was resubmitted in May 2020, and approved in August 2020, and applies to the five Worthington-UTC engines.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to develop and operate a 19.9-acre sand and gravel mine within a 35.6-acre parcel owned by David Goldie. The project site is located approximately 0.5 miles south of the intersection of Sand and Ireland Roads in the Town of Hammond. The mine will operate as a traditional surface extraction of the Raquette Sandy Loam, the predominate soil type on the site. Mining is proposed for below the local water table. Excavation of materials will be done using mechanical equipment, which is standard operating procedure for sand and gravel mines. Material will be stockpiled as unprocessed run-of-bank or processed with portable screens and crushers. Maximum processing rates for the screen and crushing operations may exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a +/-12 acres open water surface within uniformly graded and revegetated open land. Upland reclamation will include the replacement of stockpiled topsoil and reseeding with an approved USDA SCS seed mixture.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
