Project Description:

The applicant proposes to construct two surface inlets with underground outlets, a grassed waterway, and an outlet ditch which will be dug into the wetland. Use the excavated soil to fill in the gully created by erosion. Any extra soil from the construction of the outlets, waterway, and ditch not used to fill the gully will be used to create berms alongside the catch basin. The berms will not exceed 1.5'H. The project area is active farmland. The work will occur within NYSDEC regulated Class 3 Freshwater Wetland LE-14 and its regulated 100' Adjacent Area. The project area is approximately 3200' northeast of the intersection of Perry Rd and York Rd in the town of Pavilion, NY.

Project Description:

The applicant is proposing a restoration and renovation project at Hill Cumorah, which includes the demolition of an existing RV campground, the reduction and/or elimination of paved roads and paths to be replaced with more rustic and permeable materials, and the restoration of previously disturbed areas with native plantings. Significant manicured lawns will be converted to woodlands and meadows using native trees and herbaceous plantings.

The applicant is also proposing to stabilize approximately 1000-feet of a seasonal farm road with 8-inches of gravel aggregate. The proposal will result in 476 cubic yards of fill material being placed in the 100-foot adjacent area of State regulated freshwater wetland PM-18 for the seasonal farm road. Additionally, 359 cubic yards of clean fill is proposed in the wetland adjacent area to be used for grading and filling in the foundations of demolished structures. Proper sediment and erosion controls will be used to minimize potential impacts to the wetland.

Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit for the Savannah WWTF (NY0162663) pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

This is a publicly owned treatment works that receives flow from domestic users. The treatment facility provides secondary treatment for a design flow of 0.0458 million gallons per day. The facility discharges treated wastewater via Outfall 001 to Crusoe Creek and from Outfall 003 to a trib to Creamery Creek to Crusoe Creek, (all class C waters) from community septic tank, open sand filter and aeration unit treatment systems. The following changes to the permit are proposed: Removal of former outfall 002 (flows now go to Outfall 001; For Outfall 001 - New Requirement for Seasonal Disinfection (May 1- October 31) starting in 2024, TRC limit of 0.030 mg/L, Fecal Coliform effluent limits of 200 (Daily Maximum), pH and ammonia limits to correspond to Class C standards, pH minimum 6.5 and maximum of 8.5, Seasonal Ammonia Limits changed from NH3 to N, addition of a Mercury PPM special condition for Pollutant Minimization and Phosphorus Monitoring for Outfall 001; for Outfall 003 - Disinfection for Outfall 003 - given the low flow, Monitoring for Daily Max for Fecal Coliform only with option to add limit, pH and ammonia limits to correspond to Class C standards, pH to a minimum of 6.5 and a maximum of 8.5, Seasonal Ammonia Limits changed from NH3 to N and a Mercury PPM special condition for Pollutant Minimization

As a result of the EBPS full technical review, a new five-year term is proposed.The permit includes updated forms and the latest general conditions. Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.
