Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to conduct a rehabilitation and repair project of the inlet to the Binnekill Creek along the East Branch of the Delaware River and improvements along the western bank of the East Branch of the Delaware River. Proposed work includes replacement of the Binnekill culvert from a 42" to a 48" diameter culvert, construction of a boulder deflector vane and boulder revetment along the East Branch, grading of the streambank, extending rip rap on the top of the inlet, installation of native trees and shrubs, live stakes, and native grasses on disturbed areas. The project is located off State Highway 30 aprooximately 3,000 feet east of SR 30/Cemetery Road intersection.

The project involves the construction of a 5 MW ground mounted solar array and associated infrastructure (perimeter fencing, temporary and permanent access roads, inverters, overhead utility poles and lines, and stormwater controls) which will result in a "take" of approximately 48.13 acres of grassland habitat for the New York State threatened Northern Harrier and the New York State Endangered Short-eared Owl, which will be off-set through a Department-approved habitat mitigation plan.
