Project Description:

The applicant proposes the removal of 2.47 acres of potential nesting habitat/habitat within 330 feet of a core wetland for Blanding's turtles, a New York State-listed threatened species, associated with the construction of a 4-building multifamily apartment complex located at the southwest corner of the intersection of Noxon Road and NYS Route 82 in the Town of Lagrange. A Net Conservation Benefit for Blanding's turtles will be achieved through the enhancement and maintenance of 2.42 acres of on-site nesting habitat and restrictive deed covenants for the property to protect the species and the managed habitat post-development. Impacts will be minimized and mitigated through various avoidance measures to be implemented during construction (time of year restrictions, trap hazard protection, education and encounter plans).

The proposed project also involves a discharge of a maximum of 4,400 gallons per day of wastewater to groundwater from an on-site septic system, which would be eligible for State Pollutant Discharge Elimination System (SPDES) permit coverage under DEC General Permit GP-0-15-001.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V permit renewal for the Revere Smelting & Refining Corp. facility (Revere), located at 65 Ballard Road in the Town of Wallkill. Revere operates a secondary lead smelter, processing primarily used lead acid batteries.

The main source of emissions include kiln drying of lead-containing material, smelting of dried lead containing material, slag casting, refining kettles, and material handling and storage. The facility is subject to Title V permitting since the emissions of sulfur dioxide and oxides of nitrogen exceed major stationary source thresholds defined by 6NYCRR Part 201.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
