Project Description:

The applicant proposes to construct a new subsurface wastewater treatment system with a design capacity of 4,000 gallons per day (GPD) to treat sanitary and process wastewater from a new apple cider press and production facility at the Samascott Orchard's farm on Sunset Road in the Town of Kinderhook. The applicant proposes to treat process wastewater generated from cleaning procedures with an enhanced subsurface treatment system prior to discharging to groundwater; the system will consist of two 3,000-gallon septic tanks in series, an aerated pump tank, two 400-sq. ft. recirculating sand filter beds, and a 20-ft. x 60-ft. conventional absorption field.

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System Permit under Article 17 of the Environmental Conservation Law for this project. This tentative determination indicates that the discharge regulated under this statute will satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to construct a new street around a limited visibility portion of West Main Street at the southern end of the Village of Sidney. The new street will provide an alternative route and prevent emergency vehicle delays in the event an accident on West Main Street were to block through traffic. The construction of the street will also include new storm sewer, sanitary sewer, and water main. To facilitate this construction, impacts to freshwater wetland SD-2 will occur. These include permanent impacts/new impervious surface would be 0.13 acres and temporary impacts of 0.73 acres. Approximately 2,630 cubic yards of fill will be deposited within the adjacent area of freshwater wetland SD-2. The project is located at Circle Drive opposite the Circle Drive and Manatee Ave intersection and extends to a point on County Highway 4, approximately 1,000 feet south of the intersection of CH 4 and Circle Drive.
