Project Description:

The applicant proposes to install a wooden walkway through the wetlands in order to access the lake. The walkway will measure approximately 450 feet long by 4 feet wide, with vegetation cleared for 2 feet on both sides. Wooden pilings will be driven into the ground to create a base for the walkway. A 10-foot by 14-foot floating dock will be installed on Highland Lake at the end of the walkway. This action will create approximately 2,700 square feet (0.06 acres) of disturbance to NYS Freshwater Wetland HL-50, Class 2. The project is on Lloyd Lane, located on the west side of the lake, east of Hartung Road.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and maps have been checked. The proposed activity is not in an area of identified archaeological sensitivity and no known registered, eligible or inventoried archaeological sites or historic structures were identified or documented for the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

The applicant proposes to enhance stormwater management and mitigate erosion within Tibbetts Brook Park as part of a project involving road and parking-related improvements. The project will include the installation of rock outlet protections, rip rap swales, and stabilization measures at 22 locations within the park, resulting in approximately 363 linear feet of disturbance to the banks of Tibbetts Brook [Water Index Number ER-1-5, Class B].
