Project Description:

Stabilize 270-feet of stream bank along Moyer Creek in the Village of Frankfort, Herkimer County. The project will involve the construction of a stacked stone wall along the west bank, protecting the Village's electrical power infrastructure, and result in 200 cubic yards of material being excavated from below the mean high-water mark of Moyer Creek and placement of 370 cubic yards of fill being placed below the mean high-water mark. 300 square feet of federally regulated wetland will be impacted.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed and cultural resources were identified. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no adverse impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)

It has been determined that the proposed action is not subject to CP-29.

Project Description:

DEC received applications for permitting related to the construction and operation of Water District #4 Extension #1. The proposed project includes the installation of a new ground water supply wells and water mains.

A water withdrawal application requested the taking of up to 288,000 gallons per day from two wells located off Number Four Road in the Town of Watson. A hydrological report and pump test were conducted on the new wells and information included with the application materials.

Construction of the water main is proposed to cross two state regulated wetlands, L-14 and CD-4, and the adjacent area of a third, L-12. Use of directional drilling measures will reduce and mitigate the impacts of the activity. No mitigation for wetland impacts is sought.

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
