Project Description:

The applicant proposes the removal of up to 11.83 acres of documented foraging habitat for timber rattlesnakes (Crotalus horridus), a listed threatened species, associated with the construction of a nine lot subdivision on a 69.34-acre site on Mountain Farm Road and Camp Comfort Road, in the Village of Tuxedo Park, Orange County. Net conservation benefit to the species will be achieved through access grants for DEC study of the species and funding of a one-season study on road mortality. The applicant also proposes 35 linear feet of disturbance along an unnamed tributary to Tuxedo Lake [WIN# NJ 12-15-P1007-3, Class AA(T)] in conjunction with installation of a utility line.

Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit NY0110353, pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

This is a publicly owned treatment works that receives flow from domestic users. Wastewater consists of treated sanitary sewage, discharged via Outfall 001 to an unnamed tributary of Tonetta Brook, a class A water. The treatment plant provides tertiary treatment for a design flow of 0.150MGD. Current treatment consists of preliminary, secondary and tertiary. Sludge is digested aerobically, dewatered with sludge drying beds, and hauled. The following changes to the permit are proposed: Updates have been made to page 1 as well as the following pages-Definitions for Permit Limits, Levels and Monitoring Terms; Final Effluent Limits and Monitoring Requirements for Pathogen Reduction in the NYC Watershed; Discharge Notification Requirements; and, Monitoring Locations. A Mercury Minimization Program, and General Requirements have been added; Updates were made to limits and monitoring for specific parameters. A short-term high intensity monitoring for Total Dissolved Solids has been added.

As a result of the EBPS full technical review, a new five-year term is proposed. The permit includes updated forms and the latest general conditions. Details of changes are specified in the draft permit and fact sheet which may be viewed and printed from the Department web site at: http://www.dec.ny.gov/permits/6054.html.

Requests for a legislative (public statement) hearing must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8.
